Spousal Support

Spousal Support

Spousal support or alimony in Virginia is not automatic. The court has broad discretion with regard to amount and duration of spousal support, and there are no set guidelines that the court is required to follow in making its determination. It takes an experienced attorney to make a compelling argument to support your position in these cases.

At the Law Office of Stephen J. Kecskes, I have over 35 years of experience helping clients to reach a fair decision in spousal support matters. I have successfully represented both husbands and wives who are either seeking support or trying to make an argument against paying it.

Strong Representation In Spousal Support Cases

I have extensive experience in both civilian and military divorces. I will closely examine your case and give you an honest opinion about your chances of being successful. It is not my style to tell you what you want to hear and pursue unrealistic expectations.

In large part, spousal support cases come down to one spouse's need versus the other spouse's ability to pay. Support can be ordered for short term, long term or lump sum payment. There are many factors the court considers in a spousal support proceeding, and I will work tirelessly toward a result that is beneficial to you.

Among the factors the court considers in these cases are:
  • Obligations, needs and financial resources of both parties
  • Standard of living established during the marriage
  • Duration of the marriage
  • Age and physical/mental condition of both spouses
  • Contributions, monetary and nonmonetary, of each spouse to the well-being of the family
  • The property interests of the parties, both real and personal, tangible and intangible
  • Earning capacity, including the skills, education and training of the parties, and the present employment opportunities of each spouse
  • Contributions of one spouse to the education and career advancement of the other spouse
