Contested & Uncontested Divorces

A divorce is an emotional upheaval. It is also a legal dispute that must proceed and be resolved based on the guidelines set forth by our laws. Divorce can also be an opportunity — to end a marriage in a way that allows both spouses and especially any children to move forward with hope and some security.

If you are searching for an experienced divorce attorney to guide you through the divorce process with honest evaluation of your options and a focus on reasonable settlement, consider me, attorney Stephen J. Kecskes. I opened my family law practice in Virginia Beach in 1985 and have over 35 years of successful experience guiding civilians and military members through the divorce process. To schedule a free divorce consultation, contact my office today.

Uncontested Divorce: Quick And Inexpensive

Prepare and file uncontested divorce papers for a reasonable flat fee, instead of charging an hourly rate. An uncontested divorce is available if the following conditions are met:
  • The spouses have been living separate and apart for at least six months (if no minor children and a signed separation agreement) or for one year.
  • Either spouse has been a resident of Virginia for at least six months or if a military member has been stationed in Virginia for at least six months.
  • The spouses agree on all legal matters related to the divorce, including division of marital property, responsibility for marital debts, child support and spousal support, and child custody and visitation.
  • The spouses' agreement is fully described in a written document (sometimes called a separation agreement) signed by both spouses.
If everyone cooperates throughout the entire process, my office will be able to complete an uncontested divorce within approximately 30 to 45 days.

Contested Divorces: Negotiation May Still Be Possible

When I have my first conversation about obtaining a divorce, you may believe that an uncontested divorce is impossible because you and your spouse will never be able to resolve a particular dispute without the court's intervention. If this turns out to be true, I will represent you with strength and unwavering focus on obtaining the result that is best for you and any children. However, you may be surprised to discover that you and your spouse are able to reach the necessary agreements. Negotiated settlement is almost always better than a divorce decided on by a judge, and I will help you through the process by using all my considerable negotiation skills.
